1. Introduction
1.1 Welcome to Neffinity Web Design. These terms and conditions govern your use of our website and the services provided by Neffinity.
2. Acceptance of Terms
2.1 By accessing or using our website and services, you agree to comply with and be bound by these terms and conditions.
2.2 By submitting payment through an invoice issued by Neffinity, the client confirms they have read, understood, and agreed to these Terms and Conditions.
3. Services
3.1 Neffinity offers web design services, including but not limited to website development, maintenance, and related services.
3.2 All services are provided according to the specifications and requirements agreed upon with the client.
4. Payment
4.1 Payment terms will be outlined in the project proposal or agreement.
4.2 Neffinity reserves the right to suspend services until full payment is received.
5. Intellectual Property
5.1 Neffinity retains the intellectual property rights to all design elements, code, and materials created during the course of the project, unless otherwise specified in writing.
5.2 The client agrees not to reproduce, distribute, or use any materials provided by Neffinity without explicit written consent.
6. Client Responsibilities
6.1 The client is responsible for providing accurate and timely information necessary for the project.
6.2 Delays caused by the client may result in additional charges.
6.3 Neffinity reserves the right to pause a project if requested content, assets, or other deliverables are not provided in a timely manner. Work will resume once all required materials have been received.
7. Confidentiality
7.1 Both parties agree to keep confidential any information shared during the course of the project.
8. Limitation of Liability
8.1 Neffinity is not liable for any loss, damage, or expense arising from the use of our services.
8.2 In no event shall Neffinity be liable for any consequential, incidental, indirect, or special damages.
9. No Refunds
9.1 Neffinity does not offer refunds for services rendered.
10. Termination
10.1 Either party may terminate the services with written notice if the other party breaches these terms.
11. Governing Law
11.1 These terms and conditions are governed by the laws of Texas.
12. Changes to Terms
12.1 Neffinity reserves the right to modify these terms at any time. Clients will be notified of any changes.
13. Revision Policy
13.1 Neffinity may offer up to two (2) complimentary rounds of revisions after a project is completed. These revisions are provided at Neffinity’s discretion, depending on the scope and nature of the project.
13.2 If revisions are granted, they must be requested within 30 calendar days of project delivery.
13.3 If there is no client response or a delay of 30 days or more, Neffinity reserves the right to decline or void the remaining revisions.
13.4 Additional revisions beyond the initial two (if applicable) may incur extra charges, which must be agreed upon in writing.
13.5 By submitting payment via invoice, the client confirms they have agreed to these terms, including the revision policy.
